Free Divorce Record Search

There are a ton of websites on the internet that promise a free divorce record search. Unfortunately most of these are not telling the whole truth. What these websites will do is search for the people whose divorce records you would like to find and then tell you that they have found results based on that name but you then have to pay money to see the actual report. These reports are usually fairly expensive as well.

There are a number of reasons that people do a free divorce record search:

To prove genealogy lines. Often when a person passes away without leaving any will or instructions, property gets disputed and one of the ways to settle a property dispute is to look into marriage and divorce records to decide who gets what based on closeness of relation to the deceased.

To do a background check on a significant other. It is not unheard of for one party in a relationship to want to check out the other party’s relationship history. A free divorce records search is one way to find out if the person you are interested in has ever been married or divorced (sometimes you are able to find the terms of the divorce as well).

Sometimes people lose their divorce records and think that a free divorce record search will turn them up and save them a call to their former spouse or a trip to their lawyer’s office. You might need a copy of your divorce records if you ever decide to remarry-most states will want a copy of your divorce record to prove your divorce before they will issue a new marriage license. You might also need a copy of your divorce records if you ever decide to change you name.

The best way to do a free divorce record search is to contact the United States Vital Records offices. Vitalrec.com will explain how you can obtain the vital records (either yours or somebody else’s). This office not only keeps track of marriage and divorce records, they keep track of birth certificates and death records as well. Vital Records is the only office that will have definitive records of a person’s life and marriages.

You might be tempted to pay for one of those free divorce record searches, but before you feed in your credit card number, try other avenues of information gathering first. If you’ve lost your own records, it is easier to get a new copy from your lawyer or to contact your ex. If you are looking for information on somebody else and don’t feel comfortable simply talking to him or her about his or her marriage history, you might think about doing a google search for them first.

Free divorce record searches are almost never truly free. It takes a lot of searching to find a service that will not charge you a single cent to obtain records on another person. Most of the time a free divorce records search has a ton of hidden fees.

Free Divorce Record Search Tip #1

You need a lawyer. Even if you think that things will stay friendly and both you and your spouse make every effort to keep them that way, a lawyer must be consulted to make sure that everything is filled out and filed correctly. You can use the same lawyer if you want to keep the costs down, but a lawyer must be consulted.

Free Divorce Record Search Tip #2

Your County Clerk is the best place to go for divorce forms and filings. They will have the forms that are the most up to date. Using older forms can waste time and money when you are forced to fill out a more current version. Laws and forms change all the time, make sure yours are the correct ones to use!

Free Divorce Record Search Tip #3

This is not going to be an easy time for you. Even if you and your spouse are convinced that the divorce is in both of your best interests and things remain friendly, ending a marriage is never an easy process. Free Divorce record search, Make sure you have a good system of support surrounding you to help you get through it.

Free Divorce Forms

If you type “free divorce forms” into Google, you will get more than two hundred and fifty thousand results to search through. How do you make sure that you get the right forms for your state?

The best way to make sure that you get the correct divorce forms for your state is to visit your County Clerk’s office and ask for the current forms. Forms can change at any time and this is the only surefire way to make sure that you are using the current and correct version.

That said, if you just want to get an idea about what free divorce forms contain, or what kind of a process is waiting for you when you are ready to start filling out your own divorce paperwork, there are plenty of places on the internet from which to order free divorce forms.

Freedivorceforms.net is the first result in a google search for “free divorce forms.” This site offers a map of the United States on its front page. Simply select your state and click on it. From there you will be taken to a page with state provided links for the different types of forms and the different information packages that are available. Select the one that is right for you. The forms on this site can all be viewed in PDF format. You can print them out if you want to work through them step by step, or you can scroll through them with your PDF reader to get an idea of what they are like. The site also features links to other information that you might find helpful.

Divorce-Forms.com is the next site on the list. This site isn’t quite as easy to deal with as Freedivorceforms.net. It is a lot of information aright away and you have to find your state on a tabled chart. This site takes you to the Legalforms-usa.com site which has a list of the available forms and what they cost. Most of these have a zero cost price listed, but you still have to “order” them through the Legal Forms USA portal. This is where you get hit with the catch: The form is free, but the delivery method costs between two dollars and five dollars. So, technically you are not able to view the forms for free.

The better of these two sites is obviously the Freedivorceforms.net. It truly is free. Of course, you might also want to check into your local resources to see if they might have some forms that you can photocopy or look at. Check your local library or call your County Clerk. This way you will make sure you are using the current and correct forms. You should also make sure to go over your divorce forms with your lawyer before you file them. Your lawyer will make sure that you are following all of the laws of your county and state and that you haven’t made any mistakes or left anything out.

You need a lawyer. Even if you think that things will stay friendly and both you and your spouse make every effort to keep them that way, a lawyer must be consulted to make sure that everything is filled out and filed correctly.

Effects of Divorce on Children

Even in the course of the most amicable divorce, the children are going to go through some trauma, and as their parent, you need to be sensitive to what they are feeling and what they could be thinking. The effects of divorce on children can be varied and range from the mild to the severe. As a parent you need to be patient. You aren’t the only person who was traumatized by your divorce, after all.

Your children are probably very afraid that you could potentially stop loving them. All the talk you give them about always loving their other parent but not being “in” love with that parent aren’t isn’t enough to shield your child from the fear that someday you might not be “in” love with them either. All they know is that their other parent is suddenly not around very much anymore, and there aren’t words that can explain the real reason why. These effects of divorce on children can manifest itself in a number of ways. Your kids might get clingier and need more attention or they might even push you away in an attempt to make it hurt less if you decide not to love them (of course you won’t stop loving your kids, but kids aren’t always sure of this, especially during a divorce).

Your kids are also probably very angry at you. Whichever parent has more custody is going to bear the brunt of this anger. After all, whoever they live with is going to be seen as either the parent who pushed the other parent away or, conversely, the parent who couldn’t keep the other parent happy enough to stay around. If you are the “part time” parent, your kids might be very angry with you for leaving, regardless of the real reason why you left. Kids only see that one of their parents is gone, and they want to blame that on somebody. Anger is one of the most common effects of divorce on children. This anger can be expressed in outbursts and sullenness. Sometimes your kids will act up at school because they aren’t sure how to vent their anger.

Often, even when your kids say they are feeling fine, the fear and anger can manifest themselves in ways that aren’t overt. You will want to watch out for stomach aches, trouble sleeping or feeling too tired all of the time. Keep an eye on how much your kids eat during meal times. A lack of appetite is a sure sign that something is wrong.

Unfortunately there is no way to shield a child from the pain that comes from watching parents split up. You can try to ease the trauma, but the fact is that there are negative effects of divorce on children and you will want to watch out for signs of these effects. The best way to deal with these effects is to try to keep their lives and routines as normal as possible while giving them all of the extra attention they need.

Effects of Divorce on Children Tip #1

You need a lawyer. Even if you think that things will stay friendly and both you and your spouse make every effort to keep them that way, a lawyer must be consulted to make sure that everything is filled out and filed correctly.

Divorce Statistics

The divorce statistics in the United States are a very interesting read. Here are some things you might not have known about marriage and divorce in our country:

” Most people get married between the ages of twenty to twenty four. After that the rate starts to fall for both men and women, though it falls more dramatically for women than it does for men. For example, only eight and a half percent of women between the ages of thirty to thirty four get married while almost twelve percent of the men in the same age group get married.

” The rate of divorce increases with the number of marriages a person has. Between forty one percent and fifty percent of first marriages end in divorce; sixty to sixty seven percent of second marriages end in divorce and between seventy three and seventy four percent of third marriages end in divorce.

” Married couples who have children are less likely to get divorced than married couples who do not have children, but this difference is very small. It is being debated as to whether or not childlessness is actually a cause of many of the divorces among childless married couples. Sixty six percent of all divorced couples were childless when they ended their marriages.

” The United States has the highest rate of divorce in the world. 5 people per thousand are divorced in this country. The country with the lowest rate of divorce is Sri Lanka with .15 people per thousand being divorced. World wide, 1.3 people per thousand are divorced.

” Nevada is the state with the highest rate of divorce and the District of Columbia has the fewest.

” The number of marriages declined in 2005. There were forty six thousand fewer marriages in 2005 than there were in 2004. This is something of an anomaly because the population rose by 2.9 percent in the same time period.

” 2005′s divorce rate was the lowest the country had seen since the year 1970. So far the year with the most divorces was 1981.

” “Shacking up” is on the rise. 8.1 percent of coupled homes were homes in which the couples were not married.

” Only sixty three percent of the children in the United States grow up with both of their biological parents. This is the lowest rate of any country in the Western World.

” Most marriages happen between the months of June and October with August having the most of any month in 2005. January has consistently had the fewest marriages.

” Ten percent of the population is divorced. Twenty four percent of the population in the United States has never been married (and therefore has never been divorced either).

” The average age of a man’s first divorce is thirty while the first divorce statistics for women is averaging at age twenty nine.

” Only five percent of married couples reach their fiftieth wedding anniversary.

” The average length of a first marriage is almost eight years.

Divorce Rights

Getting a divorce is never ever easy and it is important that you know what your divorce rights are. Deciding to get divorced is a huge decision. It isn’t a decision that a person can make in a single second or even a couple of days. When you decide to dissolve your marriage, make sure that you know your rights. After all, a marriage isn’t only an emotional or religious commitment to your partner. It is also a legal agreement and breaking that legal agreement is a complicated process.

Most people think that in the event of a divorce the easiest thing to do is to split everything fifty-fifty. This is easy enough to assume until it comes time to actually divide the assets and property. Each partner is going to feel strong attachment to some of the things you have shared and deciding who gets to keep what-especially when both of you are emotionally attached to everything-takes time.

Each person involved in the divorce has rights. Unfortunately, there is no definitive list of rights guaranteed to each party in a divorce. Divorce rights vary by state. The best way to learn what your rights are is to talk to a divorce lawyer. Your divorce lawyer will be well versed in divorce rights and can guide you accordingly. Typically, however, the areas of divorce fall into three areas: the distribution of shared property, child custody and visitation and financial support: child support and alimony.

The distribution of shared property is exactly what it sounds like-the dividing up of physical property and monetary assets. In the event that the husband and wife cannot reach an agreement about who gets what, the court will step in and decide how to divide the assets. Usually, in the event that the court steps in, the property gets divided according to the properties of equitable distribution. This takes all emotion out of the division.

Child Custody and Visitation are the most important decisions that will be made during a divorce. This is also the most controversial part of the divorce. It is important to treat this area with special sensitivity. Children are often the unintended victims of a couple’s divorce and it is important to listen to your children as you decide where they are going to live and how often they get to see the parent they do not live with.

Financial Support: If a couple has a child it is customary for the person who does not have custody to contribute to the finances of the parent who does have custody. The amount is usually decided by a third party (usually a judge) who will look at the expenses involved with the Children’s lives. Alimony is the amount of money that one spouse is legally required to pay the other. Sometimes it is only a lumped sum, and sometimes it is in the form of a monthly payment.

Your lawyer will know what your divorce rights are and how to make sure that your rights are respected during your divorce.

Divorce Rights Tip #1

Divorce Records

Divorce records typically contain the name of the husband and wife who are divorcing, the date of their marriage and the date of their divorce. In addition, a divorce records might also include the birthdates of each of the spouses and the names (and ages) of any children they have. Divorce records can also contain the reason the couple decided to end their marriage and the property records before and after the divorce judgment.

The portion of the divorce records that people often find to be the most interesting is the divorce decree. The divorce decree is the divorce record that spells out how the divorce was settled: it states who got what property, what assets and what funds. It also states if alimony or child support is to be paid and now much and what the child custody arrangements were. It is possible for a couple to contest their divorce decree or to appeal it.

Divorce records are necessary for a number of reasons:

1. To provide a legal document stating how the marriage was dissolved and how each partner stood after the dissolution of their marriage (the division of assets, etc). This is important for any legal disputes that might later arise concerning property-either between the spouses themselves or, if one of them passes away, if children or grandchildren need help figuring out how to divide the assets among them.

2. If one or both of the spouses decides to remarry, most states require a copy of the divorce records to prove that the person applying for a new marriage license is not still married to somebody else. As polygamy is illegal, a person cannot re-marry if they are still married to their first spouse.

3. If one of the spouses decides to change his or her name, they might need to provide proof of their divorce.

4. Finding out if the person you are thinking about marrying has ever been married before and how it ended. This is the most popular reason that a third party might look into divorce records: they want to find out more about a person and don’t want to have to actually ask them (or don’t trust the response they would get).

There are many sites on the internet that promise to retrieve divorce records for a fee. While it might be tempting to try to speed up the process of getting a person’s divorce records by using one of these services, the best way to obtain a copy of a divorce record (even of your own, if you don’t have a copy) is to contact the Vital Statistics office of your state and make a formal request. Often divorce records need to be “official” and have a raised stamp-these cannot be printed out from your home printer.

Divorce records are necessary for a number of reasons-sorting out who is related to whom, how property should be divided and checking into the person you are thinking about marrying.

You can tell a lot about a society by looking at its marriage and divorce rates. We did some digging around to see what we could find out about the United States. Here are the marriage and divorce rates of our country:

Divorce Rates

In 2005, the divorce rates in the United States reached their lowest points since 1970.

To date, 1981 had more divorces than any other year in history.

Each time a person gets married it increases their likelihood of getting a divorce. First marriages have divorce rates of between forty one and fifty percent (depending on your source of information). Second marriages have a sixty to sixty percent chance of failing and seventy four percent of third marriages fail.

Divorce is more likely to occur with married couples who are childless. It’s a small difference in percentage from couples who do have children, but it is still an interesting statistic. Sixty percent of all married couples who do not have children will get divorced. Sociologists are currently debating whether or not a couple’s childless state contributes to the dissolution of their marriage.

The United States divorce rates are the highest on the planet. The United States rate is 5 people out of a thousand are divorced. Incidentally, the country with the lowest divorce rates is Sri Lanka. Only .15 (note the decimal point) people out of one thousand will get divorced.

Thirteen percent of the world’s population is divorced.

The state with the highest divorce rate is Nevada.

The state with the lowest divorce rate isn’t actually a state at all: The District of Columbia has the lowest divorce rate in the United States.

Only sixty three percent of the children living in the United States grow up in a home in which both of their biological parents stay married.

The average age for a first divorce among men is thirty, while women’s first divorce usually hits by age twenty nine.

Ten percent of the population in the United States is divorced. Twenty four percent of the population has never been married at all.

Marriage Rates

Most people are marred between the ages of twenty and twenty four. After the age of twenty four the percentage of people getting married drops off dramatically but more so for women than men. Twelve percent of men aged thirty to thirty four get married, but only eight and a half percent of women who are the same age get married.

Even though the population rose by almost three percent in 2005, the number of marriages declined. There were more than forty thousand fewer marriages in 2005 than occurred in 2004.

Most marriages take place between June and October. In 2005, August was the most popular month to get married. July was the most popular marriage month of 2004.

Of the first marriages that ended in divorce, the average length of the marriage was not quite eight years.

8.1 percent of coupled homes involving a heterosexual couple are not married. The number of couples who live together without getting married is rising steadily.

Divorce Rates Tip #1

You need a lawyer. Even if you think that things will stay friendly and both you and your spouse make every effort to keep them that way, a lawyer must be consulted to make sure that everything is filled out and filed correctly. You can use the same lawyer if you want to keep the costs down, but a lawyer must be consulted.

Divorce Rates Tip #2

Your County Clerk is the best place to go for divorce forms and filings. They will have the forms that are the most up to date. Using older forms can waste time and money when you are forced to fill out a more current version. Laws and forms change all the time, make sure yours are the correct ones to use!

Even if you and your spouse are convinced that the divorce is in both of your best interests and things remain friendly, ending a marriage is never an easy process. Divorce rates, Make sure you have a good system of support surrounding you to help you get through it.

Divorce papers are an unavoidable circumstance of getting divorced. Thankfully (or perhaps, sadly depending on the condition of your marriage) it takes more to dissolve a marriage than one person deciding that the marriage is over and then moving out. Divorce papers need to be filled out and filed. This is an article that will explain what is contained in a couple’s divorce papers.

A side note: make sure that you talk with a lawyer before filling out any divorce papers. A lawyer can help you decide your priorities. If you have children, you will also want to educate yourself on your state’s laws on child custody.

Another side note: Make sure you go to your County Clerk to get the right forms. You might be able to download some off of the internet, but each state has its own forms and the only way to make sure that yours are current and legal is to visit the County Clerk.

Before filling out the divorce papers, decide on the child custody agreement and how the assets of the marriage will be divided. If there was a prenuptial agreement, then you have some of your work done for you.

The actual process of filling out the divorce papers is pretty basic-most of the divorce papers have an easy outline to follow, but will get more complicated when you reach the child custody parts of your divorce papers. You need to remember that any sort of legal action that needs to be carried out will be decided by the laws of your state and the county where you live, so having a lawyer who knows the system will be very helpful.

Most divorce papers have a notary clause. This means that you will swear before a notary that you are who you say you are and then the notary will notarize your divorce papers. This requires that there be a witness to your signature and that you provide physical proof of your identity (like your driver’s license or passport.

If you have somebody who is not your lawyer help you fill out your divorce papers, then that person must identify themselves to the court, especially if they are not a lawyer. Courts like to know exactly who helped in the filling out of the divorce papers.

Your divorce papers are vital documents in the disillusion of your marriage. Not only are they a written record of what you think is best for you and your children, but they also contain essential legal information about the limitations that have been put in place by the federal, state and county government. They will also spell out what still needs to be worked out by a judge before the divorce can be final. The best way to make the process go smoothly is to have a lawyer who is well versed in family law help you. Divorce is never a pretty process, but by filling out your divorce papers, you are taking a necessary step to starting the next stage of your life.

Divorce Mediation

The first thing you should do when you decide to get divorced is to talk to a lawyer. A lawyer will be up to speed on all of the current divorce laws in your state and can help you fill out your divorce paper work. Some couples are determined to save money and not use a lawyer; they are convinced that they can work things out amicably. The sad truth of the matter is that no divorce is easy-no matter how amicable the split is. If you are convinced that you won’t need separate lawyers to negotiate your divorce for you, you might want to try divorce mediation.

Divorce mediation still feels new but it is quickly becoming accepted as a way to dissolve a marriage amicably. There are several different kinds of divorce mediation, but the main idea is that both spouses sit down with one lawyer who is the mediator and together the three of them decide how everything needs to be divided, who gets custody of the kids and the lawyer makes sure that everything is done to the letter of the law and that the papers are filled out correctly.

Here are some of the major reasons you should try divorce mediation:

Mediation is much easier for your kids to process. Divorce is hard enough on kids, but when they know that their parents are at odds with each other and might be behaving badly toward one another, the trauma for the children is far worse. Divorce mediation shows your kids that you and their other parent are still a team-working together to make the decisions that are best for everybody and not putting them into the middle of a volatile situation.

You can save money by using divorce mediation. Because both parties use the mediator, they can split the cost between them, which makes the expense much far more manageable.

When using divorce mediation, the spouses are allowed to follow their own time schedule. They aren’t required to set court dates or schedule lawyers. Instead the divorce is processed one division at a time. It is cooperative not antagonistic.

When you use divorce mediation, the mediator completes your paperwork for you. The mediator is also an attorney and this person can make sure that you are using the most current forms and that they are filled out correctly. They can even file your divorce papers for you and you are then free to represent yourself when your court date comes.

You get the same legal information with divorce mediation that you would get if you and your spouse each got your own lawyer. This way, however, there is no guesswork as to what your spouse’s lawyer is persuading him/her to do. Working with a mediator keeps everybody on the same track and working together. It turns your divorce into a project, not a confrontation.

It is important that you end your marriage in the most diplomatic way possible. Divorce mediation is a way to make that happen.

Divorce Lawyers

Ending a marriage is a long and arduous task and it is not something that should be undertaken lightly. It isn’t a decision that should be made quickly and it shouldn’t be your first option-especially if you and your spouse have kids. Upon deciding to get a divorce the first person you need to is a divorce lawyer. Divorce lawyers can let you know what the current divorce laws are and help you figure out the best way to dissolve your marriage.

Some couples might want to try mediation instead of getting separate divorce lawyers. Mediators are still divorce lawyers, but they work with both spouses on coming to consensual agreements about how to divide up the household assets. Mediators are a good idea for spouses who think that they can dissolve their marriage amicably and without incident. Mediation divorce lawyers are also easier for your children to deal with as mediation involves both of the parents working together to figure out what is best for the entire family while separate divorce lawyers can cause the parents to be at odds with each other-putting the children in the middle of a volatile situation.

When finding divorce lawyers, the first people you should talk to are any of your friends who have gone through a divorce. They refer you to their divorce lawyer or to other divorce lawyers they think might be a good fit for you. If you cannot get recommendations from your friends (or coworkers), then you will need to start contacting the divorce lawyers in your area. Here is a list of questions you need to ask each of the divorce lawyers you are considering working with:

1. How many divorce cases have you handled?
2. What steps are involved in the divorce process?
3. How long does a divorce usually take?
4. How many cases are you working on? Will you have time to give my case the attention that it deserves? How easily can I get a hold of you if I have questions?
5. How do you deal with clients? Can I call you or do you prefer that questions and phone conversations be scheduled?
6. How much do you cost and how do you bill your clients? Do I need to pay a retainer? Do you have an hourly rate? Can I make payments if I need to?
7. How much will the filing fees be?
8. Do you handle the cases yourself or does a lot of the work get farmed out to your legal assistant? What is the rate for the legal assistant’s service?
9. What do you feel about litigation and settling?

Make sure you get everything in writing. Not only will this help you remember everything you talked about, but it becomes a legal document to be held against future charges. Make sure that you talk to a few prospective divorce lawyers and follow up with any references they offer. You want to have a good relationship with your divorce lawyer and it might take time to find one who fits the bill.
